About Temporary Worker Visas

The Temporary Worker Visa (T5) is a work visa that permits you to work in the UK Temporarily. Previously known as the Tier 5 Temporary Worker Visa, the T5 Visa has a number of different categories. The time that you can stay in the UK on a Temporary Worker Visa varies depending on the category that you apply for and ranges from 6 months to 2 years.

You can apply for this visa if you want to come to the UK for temporary seasonal, sporting, religious or charity work as well as for work experience, training, or for an Overseas Government Language Programme, research or a fellowship through an approved government-authorised exchange scheme.

Creative Worker Visa

You can apply for a creative worker visa if you have been offered work in the UK and you are someone who works in the creative industries for example as an actor, dancer, musician or film crew member. This visa has replaced the Tier 5 Creative and Sporting visa.

Charity Worker visa

You can apply for a charity worker visa if you want to do unpaid voluntary work for a charity in the UK. This visa has replaced the Tier 5 Charity Worker visa.

Religious Worker visa

You can apply for a religious worker visa if you want to do religious work in a non-pastoral role or religious order or organisation. This visa has replaced the Tier 5 Religious Worker visa.

Seasonal Worker visa

You can apply for a Seasonal Worker visa if you are coming to the UK to work in edible horticulture, butchery, poultry work or to drive heavy goods vehicles. There are deadlines in place with these types of visas. This visa has replaced the Tier 5 Seasonal Worker visa.

General Eligibility Requirements

To qualify for a Temporary Worker visa under either of the categories above, you must:

  • Be sponsored by a UK employer that’s been approved by UKVI and holds a valid sponsorship license to that effect
  • Have a valid ‘certificate of sponsorship’ (CoS) issued by the approved sponsor (employer)
  • Demonstrate that you have sufficient knowledge of the English Language
  • Have sufficient funds to support yourself for the first 28 days when you arrive in the UK
  • For certain routes there is also a minimum salary and skill level criteria

The Fine Print

It is very important to demonstrate that you have the necessary skills, qualifications, experience or expertise for the role you are being offered and the visa route you are applying for. This will help the Home Office to determine you are being sponsored to undertake a genuine role.

Having said that, if you do not provide sufficient information there may be reasonable grounds to conclude that the role you are being sponsored to undertake will not exist or is a means to circumvent the immigration rules and is therefore a sham. In such cases, your visa may be refused.

Certificate of Sponsorship (CoS)

The most important requirement for this type of visa is to be issued with a valid Certificate of Sponsorship from your sponsoring employer. Our UK Visa Specialists can provide expert advice and technical guidance to you personally or to your employers on the criteria and issuance of a valid Certificate of Sponsorship.

Once issued, the certificate of sponsorship will remain valid to use for 3 months. The certificate must include certain mandatory information such as:

  • Your personal details
  • Job role and minimum salary
  • Start date within 3 months from the date of your application and an end date
  • Confirmation that the certificate has not been revoked/withdrawn by the sponsor or cancelled by the Home Office

Family Members

Your partner and children can also apply to come with you or join you in the UK as your ‘dependants’. They will be eligible if they are any of the following:

  • your husband, wife, civil partner or unmarried partner
  • your child under 18 – including if they were born in the UK during your stay
  • your child over 18 if they’re currently in the UK as your dependant

You must provide proof of your relationship to your partner or child for their application to be successful. You must also pay a separate fee for each dependent and show additional funds for their maintenance for the first 28 days when they arrive in the UK.

FAQs

It will take UK Visa Specialist experts no longer than 2 or 3 weeks to complete the processing of your application. In this time, we will discuss the contents of your application and the supporting documents with you.

You should try and apply up to 3 months prior to the date you are expected to start the job in the UK. Once applied, you’ll get a decision within 3 weeks (if applying from outside the UK) and 8 weeks (if applying to switch from another route from inside the UK).

You can apply for a quicker decision from inside the UK. If you are outside the UK however, the option to request a faster decision depends on which country you are applying from.

The standard fee is £244 for a visa upto 12 months. This fee is the same whether you’re applying from inside the UK or outside.

Your visa can be valid for up to 12 months or the time given on your certificate of sponsorship plus 14 days, whichever is shorter. Your employer will set the terms and length of your visa based on how long they require you to work for them.

If your partner or children are applying with you as dependents, they will also be granted the same length of visa as you. If your partner or children apply at a later date their visa will be valid up to the same date as your visa, after which you will apply to extend together.
